Dr. Luke says in recent court papers that Kesha sent Lady Gaga a text message on Feb. 26, 2016, that “repeated Defendant’s false claim that Gottwald had raped her” and “falsely asserted that Gottwald had also raped Kathryn Hudson p/k/a Katy Perry.”

Following this text message conversation, and with Defendant’s encouragement, Ms. Germanotta spread negative messages about Gottwald in the press and on social media. For example, in February 2016, Ms. Germanotta posted multiple articles discussing Defendant’s defamatory statements on her Twitter page. Subsequently, in March 2016, Defendant and Ms. Germanotta coordinated to post graphics on their Twitter and Instagram pages (which were created by Ms. Germanotta) that referred to Defendant’s claims of sexual assault by Gottwald.
Perry has never publicly accused Dr. Luke of sexual misconduct, although she has not worked with him professionally for a number of years, telling the New York Times, “I had to leave the nest.” Dr. Luke helped produce the singer’s hits including “I Kissed a Girl,” “Teenage Dream,” and “Roar.”
Kesha and Dr. Luke have been entangled in a vicious legal battle that started in 2014 when the pop star went public with allegations that the producer abused her. Dr. Luke filed a complaint that same year against Kesha for failing to work on a third album as stated in her contract. The singer filed a countersuit, seeking to be released from her contract because of her claims that Dr. Luke had raped and verbally abused her.
So far, courts have ruled against Kesha in every attempt to free herself from her contracts with Dr. Luke and his Sony-affiliated label Kemosabe. Last year, she released “Rainbow,” an album on the label that featured many songs referencing the producer.
